Calm Breathing Therapies – Client Agreement & Terms

This agreement sets out the terms and conditions on which Calm Breathing Therapies ("we", "us" or "the practitioner") provides remote Cognitive Behavioural Therapy (CBT) services to clients aged 16 and over. You ("the client") should read this agreement carefully before commencing therapy. By booking and/or attending sessions you agree to be bound by these terms.

1. Scope of Services
• Service: We deliver CBT sessions remotely via secure videoconferencing.
• Eligibility: Clients must be aged 16 or over and ordinarily resident in the United Kingdom. Therapy is provided in English.
• Exclusion criteria: We do not offer emergency or crisis services. We are not able to work with clients presenting with immediate risk of harm to themselves or others, severe active substance dependence, active psychosis, or other presentations that require multidisciplinary support. Clients requiring urgent or crisis support should contact NHS 999/112, attend A&E or contact their local crisis team.

2. Session Arrangements
• Session length: Each CBT session lasts approximately 50–60 minutes unless otherwise agreed.
• Scheduling: Sessions are held remotely at mutually agreed times between Monday and Sunday. You will receive a link to join via videoconference.
• Fees: The fee is £60 per session. A discounted block booking of four sessions costs £220 when paid in advance. Fees are reviewed annually. You will be notified of any changes before they take effect.
• Payment: Fees are payable in advance or immediately following each session. Payment is accepted via secure online payment processors (e.g. Stripe/PayPal). You are responsible for ensuring payments reach us on time.

3. Booking, Cooling‑Off Period & Cancellation
• Distance contract: Because therapy is booked online or by phone, you are entitled to a 14‑day cooling‑off period under the Consumer Contracts Regulations 2013. If you book within this period and request therapy to start immediately, you acknowledge that the cooling‑off period will still apply but that you will be charged pro‑rata for any sessions already delivered.
• Cancellation: You may cancel or reschedule a session without charge by giving at least 48 hours’ notice. Cancellations with less than 48 hours’ notice are charged at the full session fee unless due to exceptional circumstances. For block bookings, missed or cancelled sessions are not refundable but may be rescheduled within three months of purchase subject to availability.
• Termination: Either party may terminate therapy by giving reasonable notice. We may terminate services if you breach these terms, fail to pay fees, or if therapy is no longer appropriate or safe.

4. Confidentiality and Data Protection
• Confidentiality: Information disclosed during therapy is confidential except where disclosure is required by law or where there is a risk of harm to you or others. With your consent, we may discuss anonymised aspects of your case in clinical supervision to ensure safe and effective practice.
• Data protection: We process your personal and special‑category data in accordance with the UK GDPR and Data Protection Act 2018. Our lawful basis for processing is contract (Article 6(1)(b)) and the provision of health care (Article 9(2)(h)), supported by an Appropriate Policy Document. 5. Safeguarding and Risk
• We collect your GP and emergency contact details prior to commencing therapy. You must inform us of your location at the start of each session.
• In an emergency or if we believe you are at risk of serious harm, we may contact your emergency contact, your GP or emergency services without your consent.
• We are not an emergency service. If you experience a crisis between sessions, contact your GP, local crisis team or emergency services (999).

6. Records and Retention
• We keep factual notes of sessions and related correspondence. Records are retained for a minimum of eight years after the last session for adults or until the client’s 25th birthday (or 26th if they were 17 when therapy concluded) in accordance with NHS guidance and insurer requirements.
• Financial records are kept for at least six years to comply with tax laws. Further details of retention periods and your rights are set out in the Privacy Notice and Data Retention Schedule.

7. Complaints and Governing Law
• Complaints: If you have a concern about the service, please raise it with us in writing as soon as possible so that we can address it. We will acknowledge your complaint within five working days and aim to resolve it within 28 days. If you remain dissatisfied, you may contact the British Association for Behavioural & Cognitive Psychotherapies (BABCP).
• Governing law: These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.

8. Acceptance of Terms
By booking or attending therapy sessions, you confirm that you have read, understood and agree to these terms and conditions. If you have any questions about this agreement, please discuss them with us before proceeding.
